NVR Shop Purchase Terms
Effective date: August 21, 2026
These Purchase Terms apply to products sold through NVR Shop. By placing an order, you agree to these terms. Rental orders are governed by the separate Rental Agreement.
1. Order Acceptance
An order confirmation acknowledges that we received your order; it does not guarantee acceptance. NVR Shop may review, accept, decline, or cancel an order before shipment for reasons including product availability, pricing or listing errors, payment authorization, suspected fraud, legal restrictions, or an inability to complete the selected configuration. If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.
2. Product Configurations and Night Vision Tubes
Many night vision systems are built or configured to order. Product photographs are representative and may not show the exact unit delivered. Cosmetic appearance, serial numbers, tube data, screen characteristics, and component markings may vary.
When an order includes a tube grade, performance range, hand-selection service, housing color, optics package, or other configuration, the completed product will be supplied according to the selections shown in the order confirmation. Individual image intensifier tubes naturally vary within an advertised grade or performance range. Unless a specific specification is expressly guaranteed in writing, published figures are ranges or minimums rather than a promise of an exact value.
3. Pricing, Payment, and Taxes
Prices are shown in U.S. dollars and may change without notice before an order is placed. The price displayed at checkout, together with applicable shipping, taxes, and approved surcharges, controls the order. Payment must be successfully authorized before fulfillment begins. The customer is responsible for applicable sales, use, and similar taxes unless a valid exemption is accepted.
4. Availability, Lead Times, and Shipping
Stock status and estimated lead times are estimates and may change because of component availability, manufacturer delays, inspection, tube selection, assembly, testing, or other circumstances. If no shipping time is stated, we will ship within the time required by applicable law. If we cannot ship within the promised time, we will provide the legally required delay notice and offer any cancellation or refund rights required by law.
Shipping charges and available services are shown at checkout. Direct signature may be required or offered for high-value shipments. The customer is responsible for providing a complete, accurate, and secure delivery address. Title and risk of loss transfer as provided by applicable law and the carrier’s delivery record, subject to any non-waivable consumer protections.
5. Delivery Problems
Inspect the shipment promptly. Report visible shipping damage, missing items, or an incorrect product to NVR Shop within 3 business days after delivery at info@nightvisionrentals.com or 702-749-0333. Keep all packaging and provide photographs when requested so we can assist with a carrier or warranty claim. This reporting period does not reduce any rights that cannot legally be limited.
6. Cancellations
Contact us immediately if you need to cancel. A standard in-stock order may be cancelled before it enters shipment. A custom-configured, hand-selected, special-order, or built-to-order item may become non-cancellable once component procurement, tube selection, assembly, or other custom work begins. If cancellation is still possible after costs have been incurred, the refund may be reduced by documented, non-recoverable costs to the extent permitted by law.
7. Standard Returns
Unless a product page states a different policy, an eligible standard product may be returned within 14 calendar days after delivery. Contact us before sending anything back to obtain return authorization and instructions.
- The product must be returned complete, undamaged, and with all included accessories, manuals, documentation, and original packaging.
- Unopened, unused, non-defective standard products are not subject to a restocking fee.
- Opened or used non-defective standard products may be subject to a restocking fee of up to 15% to cover inspection, testing, repackaging, and reduced resale value.
- No restocking fee will be charged when the return results from a verified defect, shipping damage, or an NVR Shop fulfillment error.
- The customer is responsible for authorized return shipping on a non-defective return. We recommend insured, trackable shipping because the customer remains responsible for the package until it is received.
Products returned without authorization, incomplete products, damaged products, or products showing misuse, unauthorized modification, abuse, or missing serial-number labels may be refused or may receive a reduced refund as permitted by law.
8. Custom and Final-Sale Products
Custom-configured, hand-selected, special-order, clearance, and expressly identified final-sale products are not returnable for preference-based reasons once procurement, tube selection, assembly, or customization begins. This includes a product built using customer-selected housing, color, optics, tube type, tube grade, performance level, or other configuration choices. Final-sale status does not eliminate remedies for a verified defect, shipping damage, incorrect item, or other rights that cannot be waived.
9. Refunds
Approved refunds are issued to the original payment method after the returned product is received and inspected. Original shipping charges are not refundable on a non-defective return unless required by law. Banks and payment providers may require additional time to post a refund.
10. Defects and Warranties
Products may include a manufacturer or component warranty. The warranty period, coverage, exclusions, and remedy are controlled by the written warranty supplied with the product or published by the applicable manufacturer. NVR Shop will reasonably assist the original purchaser with a valid warranty claim, but does not expand a manufacturer’s warranty unless we provide a separate written warranty.
Damage caused by misuse, impact, liquid intrusion, improper power sources, improper storage, unauthorized repair or modification, failure to follow instructions, or ordinary wear is not a manufacturing defect. Nothing in these terms excludes warranties or consumer rights that cannot be disclaimed under applicable law.
11. Lasers, Restricted Products, and Safety
Some products, including certain laser products, may be regulated, restricted to qualified buyers, or subject to manufacturer distribution requirements. NVR Shop may require eligibility documentation and may decline or cancel a restricted-product order when the sale or shipment is not permitted. Customers must follow all product warnings, training requirements, safety instructions, and federal, state, and local laws. Never point a laser at an aircraft, person, vehicle, or any target where exposure or distraction could cause injury or violate the law.
12. Export Controls and U.S. Use
Night vision devices, components, technical data, and related products may be controlled under the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), or other U.S. laws. Products are offered for lawful U.S. sale and use only unless NVR Shop has expressly approved another transaction in writing after the required export review and authorization.
The customer must not export, re-export, transfer, release, carry, mail, or provide a controlled item or related technical data to a foreign destination or foreign person without every required U.S. Government authorization. The customer is responsible for determining and complying with all applicable export-control, sanctions, and end-use restrictions.
13. Lawful Purchase and Use
The customer represents that the purchase, possession, and intended use of each product are lawful in the customer’s jurisdiction and that the product will not be used for an unlawful purpose. The customer is responsible for training, safe operation, and compliance with all applicable federal, state, and local requirements.
14. Limitation of Liability
To the fullest extent permitted by law, NVR Shop will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from a product, delayed shipment, or use of the website. To the fullest extent permitted by law, NVR Shop’s aggregate liability for a claim related to a product will not exceed the amount paid for that product. These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.
15. Privacy and Fraud Prevention
Order and customer information is handled according to the website Privacy Policy. We may use reasonable payment verification, identity verification, address verification, fraud screening, and restricted-party screening before accepting or shipping an order.
16. Governing Law
These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any permitted dispute that is not otherwise resolved will be brought in a court of competent jurisdiction in Clark County, Nevada, unless applicable law provides the customer another venue.
17. Severability and Changes
If any provision is found unenforceable, the remaining provisions will continue in effect. The terms posted when an order is placed will govern that order. We may revise these terms for future orders by posting an updated effective date.
